Terms of business

These conditions determine the procedure for ordering, payment, delivery and complaints of products offered on the website/web store www.promostart.hr (hereinafter: "Promostart.hr"). By accessing this page, it is considered that the Customer has read these Terms of Business, understood them, and that the Customer accepts them by placing an order or purchasing a product.

General terms

Ordering or sending product inquiries via Promostart.hr is possible 24 hours a day, 7 days a week. Our sales agents answer inquiries and make offers on weekdays from 8:30 a.m. to 4:30 p.m.

A product buyer is any legal person who visits Promostart.hr, selects a product, puts the product/s in the shopping cart and sends an inquiry via Promostart.hr. After receiving the inquiry, our sales agents will send an informative offer according to which the client can make a payment according to the purchase price in full. The order is considered confirmed by Virman payment according to the offer/proforma invoice. If the client needs the personalization of the article (printing), then in addition to the confirmation of payment, approval of the visualization of the personalized article by the customer is also required, for the products the client has chosen.

A product is any item found on Promostart.hr, marked with a price and item number (code).

The images of the products are only illustrative in nature, and do not always have to correspond in all details to the products that are actually available. Considering the possibility of individual computer monitor settings, differences in the perception of product colors by the human eye, etc., the Seller does not guarantee the complete conformity of the product colors with the colors as the Buyer sees them on the screen of his monitor.

Ordering

The product is considered ordered when the Buyer sends the payment confirmation by e-mail to the address: info@promostart.hr. A product with personalization (printing) is considered ordered at the moment when the Customer confirms the simulation of the personalized article, and sends the payment confirmation by e-mail to the address: info@promostart.hr. Through Promostart.hr, the Buyer is enabled to purchase all Products that are on the Seller's website, only if the desired products are not available in the warehouse at a given time.
Customers can only be legal entities that accept these Terms of Business, which they confirm by ordering the Product on Promostart.hr.

Confirmation of the order by the seller

The customer will receive the order confirmation notification by e-mail immediately after receiving the confirmation, which contains all the details prescribed by law and these Terms of Business. The seller reserves the right to cancel the order at any time, and thereby undertakes to make a full refund within the prescribed legal period.

Prices

All prices are expressed in the Croatian national currency, euro (€), excluding VAT. The highlighted prices of the Products on Promostart.hr are the official price list of the Seller.

Payment

Ordered Products with additional delivery costs (if any) will be paid by the Buyer to the Seller by bank transfer when confirming the order.

Privacy statement

The data of a natural and/or legal person (name and surname, company name, address, contact phone number, e-mail of the Customer and payment information) is at the disposal of the Seller, and the Seller undertakes to carefully store the data, in accordance with the current Act on the Protection of Personal Data and other appropriate regulations.

The data of natural and/or legal persons are known only to competent persons who carry out the necessary procedures in order for the purchase and sale of Products to be carried out successfully and properly. If the information specified in these Terms of Sale is not entered, it will not be possible to send an inquiry and/or make a purchase of the Product via Promostart.hr. The data is handled manually and via IT. Data submitted to the Seller may be forwarded to specialized companies and organizations that perform data processing services on behalf of the Seller, in relation to which each Customer gives their express consent through the order/purchase of the Product through Promostart.hr and by accepting these Terms of Business.

Delivery

Delivery is made by the Seller via authorized courier services and post office.

Due to the production and printing process, we reserve the right to deliver and invoice +-5% of the quantity of products specified by the Customer in the order, unless otherwise stated.

Postage

Postage costs are borne by the Seller, except in the case of ordering samples. When returning the ordered Product, the Customer bears the cost of the return. If a mistake was made by the Seller or if it is a mistake on the Product itself, the costs of return are borne by the Seller. The decision on responsibility for the cost is made by the Seller at its own discretion.

Delivery conditions

The Seller undertakes to send the ordered Products (hereinafter referred to as the "Shipment") via one of the courier services operating in the Republic of Croatia, within 5-7 working days from receipt of the confirmation of payment for the Product, i.e. confirmation of the order. In the case of ordering products with personalization, the delivery time depends on the quantity of ordered products and the current capacity of the printer - our agent can give you an approximate deadline after receiving the inquiry. The seller does not guarantee the delivery time after handing over the shipment to the person authorized to collect the shipment by the courier service. We will try to deliver all ordered Products in one package, i.e. in one shipment. If the aforementioned will not be possible, due to the state of stock, the Seller reserves the right to deliver in multiple shipments.

Unavailable products

Products that are unavailable at the time of ordering cannot be ordered. In the event that the ordered Product becomes unavailable after the order has been placed, the Seller will inform the Buyer (in writing or by phone) about the possible delivery date. The customer can then accept the new delivery date or cancel the order. If the Buyer decides to cancel the order, the Seller will return the money to him no later than within 30 days from when the delay occurred. All possible refunds are made through the Seller's business account to the Buyer's business account in the bank.

Free delivery

Free delivery applies to all amounts that exceed the minimum order amount of €250 + VAT.

Other terms of delivery

The products will be packed so that they cannot be damaged by normal handling during transport. When picking up the Parcel, the customer is obliged to check for possible damages and immediately report them to the courier service worker who delivered the Parcel, or refuse to pick up the Parcel with visible external damage.

Complaint, replacement, refund

Complaint

The Purchased Product, which the Customer has not used, has the right to return it within 15 days from the day of collection of the Shipment. When returning the product, it must be in its original condition and without visible signs of use or other damage. If the Buyer decides to complain about the Product, he must immediately notify the Seller of his intention via e-mail info@promostart.hr. In the case of a valid complaint, the costs of postage when sending the package with the complained Products are borne by the Seller. In the event of abuse of the right to complain, the Seller reserves the right to terminate further cooperation and suspend the delivery of new orders. The seller decides on the validity of the complaint at his own discretion.

Replacement

In the event that the Buyer changes the quantity and type of Products, the costs of replacement and delivery shall be borne by the Buyer.

Refund

Refunds in the case of a valid Customer complaint will be made by paying the amount equal to the sales price of the returned Products to the Customer's business account within 30 days from when the complaint was reported.

Promotions

Promotional actions do not apply to existing orders and cannot be combined with other actions and discounts.

The customer can submit his written complaint in terms of Article 10 of the current Consumer Protection Act to the address:

Disclaimer

The seller reserves the right to typographical errors. In the event of a wrong price or text in the online store www.promostart.hr, the price or text communicated by the sales agent, i.e. an employee of the company BIZ START d.o.o., is authoritative.
The seller has the right to change the Terms of Business at any time, as well as the right to terminate access to the Promostart.hr website without prior notice. In order for the Customer to be aware of possible changes to the Terms of Business, the Customer is obliged to periodically read the Terms of Business. By the very use of the Promostart.hr website by the Buyer, it is understood that the Buyer is familiar with all changes and that the Buyer understands and accepts them. If the Customer does not agree with the Terms of Business, he shall refrain from using the Promostart.hr website. The Seller excludes responsibility for any damage caused to Buyers or third parties as a result of such changes.
